Re: Disposition of Timber from
Access Roads - Gap Filer Sites
We spoke on the above named subject as it refers to the draft letter under and I expressed the opinion that it would seem preferable, when we acquire the sites for the access roads, to acquire the entire rights including the interest in timber. This would facilitate DCL dealing with the disposal of merchantable timber as a clause in their construction contract. This, of course, presupposes that the main road contractor would effect timber cutting.
If, as is inferred in your draft letter, we were to acquire the timber rights from the province and the lumber companies and cut the timber by Crown resources, I doubt that we would have adequate authority to effect disposal without reference to Crown Assets Disposal Corporation.
In the circumstances, I would appreciate you having another look at the letter to the Deputy Minister of Transport having regard to the foregoing comments.

Please note ADM (C&P)/SP's minute above; do you concur in the opinion that the Crown buy the timber in all cases, making its disposal a part of the construction contract?
